Two Ex-FBI Leaders Face Prison Terms for Alleged Perjury on Hunter Biden Laptop

Federal prosecutors claim two senior agents intentionally misled Congress regarding their knowledge of a major digital evidence probe, risking five years in jail for each.

Federal prosecutors have formally charged two former senior FBI officials with lying to Congress about their involvement in the Hunter Biden laptop investigation. The Justice Department announced the indictment on Friday, marking a significant escalation in the long-running dispute over the handling of digital evidence from the former president's son.

The charges target Nikki Floris, who led the intelligence division at the FBI's Washington field office, and Bradley Benavides, a former deputy assistant director for counterintelligence. Prosecutors allege that both men and women intentionally concealed key details while testifying before the House Judiciary Committee in 2023. If a jury finds them guilty, each faces a potential prison sentence of up to five years.

According to an FBI affidavit, Floris repeatedly denied any role in the Hunter Biden investigations during her congressional testimony. The document claims she was actually in frequent communication with the case team for more than a year, exchanging information about the subject. It also states she testified that she knew nothing about the laptop, despite coordinating the bureau's real-time response to news reports about it.

Benavides testified a few months after Floris and told the committee he had minimal knowledge of the matter. He claimed he learned about the laptop from a Wikipedia entry while preparing for his session. The affidavit counters that he was in constant communication about the device over several days. One committee member stated that these answers significantly shaped the investigation, including by blocking follow-up interviews and subpoenas.

US Attorney Jeanine Pirro, whose office is leading the prosecution, issued a strong statement calling the pair's actions a betrayal of their oaths. She argued that lying to Congress strikes at the core of the democratic system. Pirro added that when senior agents act as if they are above the law, it is time to bring the full force of justice against them.

Defense lawyers for Floris rejected the allegations, arguing that the Justice Department relied on political claims rather than facts. They described their client as a patriot who served as an intelligence officer for nearly two decades. They noted that the charges were filed years after the fact, right before an election, suggesting a strategic timing. Ron Safer, Benavides' attorney, asked the court to hold a hearing to determine if there was enough evidence against two lifetime public servants.

US Magistrate Judge Zia M. Faruqui raised questions about the timing of the case, noting that the charges came more than three years after the original testimony. He granted the defense's request for a hearing to weigh the government's evidence. This hearing is scheduled for Tuesday, which is unusually soon for defendants who have already been released. Faruqui described the situation as rare but acknowledged the gravity of having such old charges hanging over the defendants.

The judge noted that both individuals had strong backgrounds in law enforcement and a clear interest in clearing their names quickly. He used the metaphor of a Sword of Damocles hanging over their heads, indicating that the legal burden would follow them for the rest of their lives. Both Floris and Benavides were released on Friday morning after a brief appearance before the magistrate judge.

The laptop at the center of this legal battle remains a major point of political division. Republicans view it as key evidence of corruption within the Biden family, while Democrats characterize it as part of a partisan strategy. The device was handed to the FBI in 2019 after a computer shop owner reported that Hunter Biden had dropped it off and never returned to pick it up. The owner told the Washington Post that he turned it over to authorities after reviewing some of its contents.

This case arrives at a sensitive moment for the FBI. Many agents who were accused by allies of President Donald Trump of working against him have been pushed out of the bureau since the start of his second term. Some claim they were dismissed solely for working on investigations involving the president, while others say they were fired for a lack of loyalty.
